Terms of service

What the software does, and what it deliberately does not promise.

This is a plain-language draft of the terms under which the platform is offered. It is written so a reviewer can see the real limits of the product rather than a wall of boilerplate.

Draft for pilot review

Draft for pilot review. This document describes how the product works today and is not a signed agreement. The final terms, data processing agreement and company details are provided and signed during onboarding.

1. What the service is

Libera is software that helps a company screen suppliers and sites for forced-labour risk indicators, operate a confidential worker reporting channel, cluster the resulting signals, manage cases and produce due-diligence documentation. It is provided as a hosted service to the contracting organisation and its named users.

2. Risk indicators are not findings

Scores, red flags, list matches and raised statuses are indicators derived from published data sources and from signals submitted through the worker channel. They do not establish that forced labour, human trafficking or any other offence has occurred, and they must never be presented to a supplier, an auditor, a regulator or the public as a finding or an allegation.

3. Human review is required

The customer remains responsible for reviewing every raised status, deciding what to investigate, and recording the outcome. The software escalates and documents; it does not decide. Automated screening output must not be used as the sole basis for terminating a supplier, disciplining a person or making a public statement.

4. No compliance, legal or regulatory guarantee

The service supports due-diligence documentation for frameworks including the CSDDD, the EU Forced Labour Regulation, UFLPA, the UK Modern Slavery Act, the German LkSG and the Norwegian Transparency Act. It does not guarantee compliance with any of them, it is not legal advice, and it carries no regulatory approval, accreditation or certification. Legal obligations remain with the customer.

5. Acceptable use

The service may not be used to identify, retaliate against, pressure or discipline a worker who uses the reporting channel; to attempt to re-identify a reporter; to probe, load-test or reverse engineer the platform; to upload unlawful content; or to submit knowingly false reports. Attempted re-identification of a reporter is grounds for immediate suspension.

6. Not an emergency service

The reporting channel is not monitored around the clock and is not a crisis line. Situations of immediate danger belong with local emergency services or a national helpline. Every worker-facing page states this.

7. Accounts and security responsibilities

The customer controls who is invited into its workspace and which role each person holds. The customer is responsible for keeping credentials confidential, removing users who leave, and configuring roles so that only appropriate people can record checks, close cases or export reports. Suspected account compromise should be reported to us without delay.

8. Customer data

The customer keeps ownership of the supplier records, cases, evidence metadata and documentation it enters. We process that data to provide the service, as described in the privacy statement and the data processing agreement. Deletion on request is covered there.

9. Availability and change

The service is under active development and features may change. No specific uptime level is promised on this page; any service level applicable to a pilot or subscription is set out in the signed order documentation rather than here.

10. Liability

The service is provided on the basis that it produces indicators for human judgement. A limitation of liability, warranty position and indemnity regime will be set out in the signed agreement and are deliberately not stated here, because conservative placeholder wording on a public page is not a contract and should not be relied on as one.

Contracting party and governing law

The contracting entity is [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS] under [REGISTRATION NUMBER]. Governing law and the competent court are [GOVERNING LAW / COURT]. These values are outstanding and are supplied in writing before signature — they are not stated here until verified.

Company details

Brand name and legal details are not the same thing.

Libera Europe is the operating brand of the platform. The verified legal entity details below are not published yet. Rather than showing an unverified value, each outstanding item is marked — procurement receives the completed set before any contract is signed.
